Booking Terms & Conditions

Please read these booking conditions carefully, as they form an important part of the contract for your experience with us. Please only make a booking if you understand and agree with these Booking Terms & Conditions. Your booking and participation in the experience is therefore confirmation that you understand and agree to these terms and conditions. These Booking Terms & Conditions apply to bookings you make directly with Enroute54 Ltd, bookings through our affiliate websites, and bookings through our website www.enroute54.com.

Your Booking

These conditions together with any other information we bring to your attention before we confirm your booking, form the basis of your contract with us for the travel arrangements making up your booking (your ‘arrangements’ or ‘trip’). Please read them carefully as they set out our respective rights and obligations. By making a booking with Enroute54, you agree to be bound by all of these terms and conditions.

In these Booking Terms & Conditions references to “you” and “your” include the named person on the booking, and all persons named on the booking (including anyone added or substituted at a later date). By making a booking, the named person on the booking agrees on behalf of all persons detailed on the booking that:

  1. You have read these terms and conditions, have the authority to and agree to be bound by them;
  2. You consent to our use of information in accordance with our Data Protection Clause in our Privacy Policy.
  3. You are over 18 years of age when purchasing a service and where services with age restrictions declare that you and all members of the party are of the appropriate age to purchase those services.

Key Terms of Agreement

  1. You are entering into a contract with us when we issue our confirmation. If you cancel your arrangements, you will be required to pay cancellation charges. Initially, this will be the deposit you paid to secure your arrangements, but once you have paid the full balance of the price of your arrangements, these charges may increase, according to the cancellation policy. Charges can increase up to 100% of the charges made towards your trip depending on how close to the date of your planned travel trip you cancel your booking.
  2. You may make changes to your confirmed arrangements in certain circumstances. A processing fee may be charged depending on the desired changes.
  3. Confirmed arrangements may be amended or canceled in certain circumstances further elaborated upon in these booking terms. You may be entitled to a refund depending on the circumstances.

1. Prices, Description, Confirmation & Payment Terms

1. a) Prices

All prices for services provided by us are quoted in US Dollars [USD]. All prices are subject to availability and may be withdrawn or varied within reason without notice before bookings are confirmed. Prices are per person and inclusive of tax unless otherwise indicated. The information and prices shown may have changed by the time you book your arrangements. We make every effort to ensure the accuracy of the information and prices at the time of publication. You must therefore ensure you check the price and all other details of your chosen arrangements with us at the time of booking. Should we become aware of the need to revise information or prices, we may do so by informing you before we accept your booking. In this case the revised information or prices will be considered to form part of our contract with you as if they had originally been published on our website, affiliate website or given directly to you. Once bookings have been confirmed, no further variations will be made to prices.

1. b) Descriptions

Experiences sold by us are performed in tandem with vendors and suppliers who provide their services through us. As such, we cannot guarantee that their services will correspond exactly with the description or photograph by which the services were sold.

1. c) Booking Confirmation

Bookings can be made by completing and signing our booking form, which you will need to complete on our website or via our affiliate websites, along with your deposit payment. You are also able to make bookings directly with us through our team and make a deposit payment directly to us through our team. Once we have received all appropriate completed forms and payments, we will, subject to availability, confirm your booking by issuing a confirmation invoice. A binding contract between us comes into existence when we dispatch our confirmation invoice to the named person on the booking. Upon receipt, if you believe that any details on the confirmation (or any other document) are wrong you must advise us immediately as changes may not be made later.

1. d) Payments

When you make a booking, you agree to pay the cost of the travel experience, including any charges, taxes, local levies and payment fees that may apply. 100% of payment must be made by Final Installment Date / Payment Deadline detailed for each trip. Please note that if we do not receive all payments due in full and on time, we reserve the right to treat your booking as canceled by you. In this case the cancellation charges set out in our cancellation policy will be payable. Please note that if an invoice is not paid on the due date, our ability to complete the necessary work according to the timeframe and to secure service components to faithfully deliver services as described in this agreement will be hindered. In the event that the Scope of Work is affected i.e., venues/vendors canceled, date, availability or pricing changed etc, as a result of late invoice payments, we will not be held liable for such changes and/or charges that may be incurred as a result. You agree to accept reasonable recommended changes and reasonable related charges that will have to be adopted as an alternative plan as a result.

2. Booking Validity, Changes and Cancellations by You

If you wish to change any part of your arrangements after our confirmation invoice has been issued, you must inform us in writing as soon as possible. We have no obligation to make these changes, however we will do our best to help accommodate changes requested. Where we can meet a request, all changes may be subject to an administration fee and will be subject to any additional charges levied by ground operators and service providers. You should be aware that the costs of making a cancellation or change could increase as you approach the departure date. If changes are required you should contact us as soon as possible. We shall not be held liable for any loss or inconvenience arising from amendments or cancellations resulting from non-compliance with terms detailed herein.

2. a) Booking Amendment Limitations

Once a booking has been confirmed by us in writing and the initial deposit has been received, you have the flexibility to make up to two (2) significant amendments to your confirmed itinerary, subject to availability and the terms set out herein. Significant amendments may include, but are not limited to, changes such as significant date adjustments, significant accommodation modifications, significant change of participant numbers or significant change of scheduled activities. All amendment requests must be submitted in writing and shall be considered on a case-by-case basis. While we will do our utmost to accommodate significant changes, we note that any amendment is subject to the availability of services and the terms and conditions of third-party service providers and may incur additional costs based on service providers, which will be communicated and agreed upon in advance.

2. b) Booking Validity Period

The total duration between the date of the first deposit payment being received and the scheduled commencement date of travel, shall not exceed twelve (12) calendar months. In the event that the booking dates fall beyond this twelve-month period, we reserve the right to cancel or to reissue a new quotation based on then-current rates and availability, and any applicable change or cancellation fees will apply.

Note: Cancellations must be made by the named person on the booking and they should be made in writing by email to info@enroute54.com, and will take effect when receipt of the email is acknowledged by us via info@enroute54.com within 48 hours. You will receive an updated invoice confirming any cancellation terms within two weeks of receiving your correspondence. Since we incur costs in canceling your arrangements, you may be liable for the applicable cancellation charges up to the maximum shown in the table above. The cancellation charge is calculated on the basis of the total cost payable by the person(s) canceling excluding amendment charges, deposit and last installment payments, which are non-refundable in the event of cancellation by the applicable guest. All cancellation charge(s) will be deducted from any monies you have already paid to us. Please note that refunds are subject to foreign exchange rates and payment provider fees.

2. d) Refunds

Once the trip has begun, no refunds can be made. Prices for your experience are normally based on group bookings, therefore, no refunds will be made on any parts of the itinerary in which you do not wish to participate. If the reason for your cancellation is covered under the terms of your own personal travel insurance policy, you may be able to reclaim any cancellation charges via your travel insurance provider, which is independent of us. Claims must be made directly with your insurance company. Any refunds that we do make will be made within reasonable time and will be subject to receiving refunded monies from vendors and ground handlers used. No refunds will be provided if cancellations are not made in line with terms detailed herein.

3. Changes and Cancellations by Us

3. a) Changes and Cancellations Before Departure

Most changes will be insignificant (as determined in our sole discretion) and we reserve the right to make them. If we make an insignificant change to your main arrangements, we will endeavor to notify you as soon as reasonably possible before your experience. We will have no other responsibilities to you in respect of any insignificant changes.

3. b) Significant Changes

Occasionally, we have to make a significant change and we reserve the right to do so. A significant change is one where we or our suppliers significantly alter any of the main characteristics of your arrangements. Examples of significant changes include the following changes when made before departure:

  • A change of accommodation or area for the whole or a significant part of your time away.
  • A change of outward departure time or overall length of time that your arrangements cover of twelve hours or more.
  • A significant change to your itinerary, missing out one or more destinations entirely.
  • Where we or a vendor can no longer fulfil any special requirements that we have accepted and confirmed on our confirmation invoice and this will have a significant impact on your arrangements.
  • Where we increase the price of your arrangements by more than 8% of the price of your arrangements (excluding any amendment charges and/or additional services).

If we have to make a significant change or cancel before departure, we will inform you without undue delay and if there is time to do so before departure, we will offer you a suitable alternative arrangement of comparable standard. Any decision made to change or cancel the trip will be made in the best interest of all participants with regards to the safety of the group.

3. c) Changes and Cancellations to Package Arrangements After Departure

Should Enroute 54 or a vendor be unable to provide a specific part of your package arrangements after you have departed, Enroute 54 shall provide alternative arrangements of equivalent quality. Should we be unable to provide the alternative, we will inform you and will pursue a refund from the vendor. Enroute 54 will send any refunds due to the Customer within 48 hours of receiving such refund from the vendor.

Please note: In the event of extraordinary circumstances beyond our control and related disruptions, clause 10 and clause 11 will apply.

4. Passports, Visas, Health Formalities & Travel Documents

It is your responsibility to check and fulfill the passport, visa, health and immigration requirements applicable to your itinerary for your group booking. We can only provide guidance and general information about this. You must check requirements for your own specific circumstances with the relevant Embassies and/or Consulates and your Doctor as applicable and advise your group accordingly. Requirements do change and you must check the up-to-date position in good time before departure. You must ensure you have the correct travel documents in your possession before departure, failing which you will be liable for any costs. It is your responsibility to ensure that your group is fit to travel and to take all necessary medication etc. with them. We do not accept any responsibility if your group cannot travel, or incur any other loss because you have not complied with any passport, visa, immigration requirements or health formalities. You agree to reimburse us in relation to any fines or other losses which we incur as a result of your failure to comply with any passport, visa, immigration requirements or health formalities. Any cancellation that arises due to visa/passport requirement will be subject to the cancellation charges detailed above.

5. Accommodation

Any accommodation we arrange for you must only be used by the people with the names stated on your confirmation document (or the relevant most up-to-date, amended documentation).

6. Our Responsibility to You

We will provide the services in accordance with our customary standards of professionalism exercised towards our clients and exercise due diligence in the provision of our services. The provision of services will include the thorough planning of services and the execution and delivery of those services. This will be in accordance with the itinerary as advertised to and shared with guests.

7. Accident Waiver, Content and Release of Liability

7. a) Accident Waiver & Release of Liability

By booking with us, you acknowledge and accept all risks associated with participating in the activities outlined in your chosen itineraries. These risks include, but are not limited to, those arising from negligence or carelessness on the part of Enroute54, its successors, officers, employees, representatives, partners, and agents (hereinafter referred to as the ‘Released Parties’). You understand and agree that the Released Parties shall not be held liable for any injuries, damages, or losses, including those caused by dangerous or defective equipment or property, whether owned, maintained, or controlled by them, to the fullest extent permitted by law.

You certify that you are in good health, have no physical conditions that affect your ability to travel and/or participate in any of the activities involved in the travel itinerary and have not been advised to not participate by a qualified medical professional. You certify that there are no health-related reasons or problems which preclude your participation in activities that you have booked with us.

Enroute54 and organizers of the activities in which you may participate will rely on your representations in this clause and this will govern your actions and responsibilities. By booking with us you waive, release, and discharge Enroute54 from any and all liability, including but not limited to, liability arising from the negligence or fault of Enroute54, for your death, disability, personal injury, property damage, property theft, or actions of any kind which may hereafter occur to me including your traveling to and from these activities. You also acknowledge that Enroute54 is not responsible for the errors, omissions, acts, or failures to act of any party or entity conducting a specific activity you booked through us.

You acknowledge that the travel activity carries with it the potential for death, serious injury, and property loss. The risks include, but are not limited to, those caused by terrain, facilities, temperature, weather, condition of participants, equipment, vehicular traffic, lack of hydration, and actions of other people including, but not limited to, participants, volunteers, monitors, and/or producers of the activity.

You consent to receive medical treatment which may be deemed advisable in the event of injury, accident, and/or illness during activities.

7. b) Photography & Videography

You understand that while participating in travel with Enroute54, that you may be photographed or videoed. You agree to allow your photo, video, or film likeness to be used for promotional and marketing purposes by Enroute54.

This clause (7) seven shall be construed broadly to provide a release and waiver to the maximum extent permissible under applicable law.

8. Limitation of Liability

We are not liable for any losses or damages which were not reasonably foreseeable when you made your booking or otherwise entered into these terms or any event which was reasonably beyond our control. We shall not be liable for errors which are attributable to you, any third party vendor or which are caused by unavoidable and extraordinary circumstances as defined in the Force Majeure clause in this Agreement. In any case, our maximum liability for any individual under this agreement is the total cost of your individual booking. The above sets out the extent of our liability for changes and cancellations.

9. Luggage or Personal Possessions and Money

You are responsible for the protection and safe keeping of your personal possession and money. We are not liable to make payment for any loss of and/or damage to any luggage or personal possessions or money you incur while on the trip, and advise all guests to purchase an insurance policy which applies to and covers any losses of this kind.

10. Force Majeure

Except where otherwise expressly stated in these booking conditions we shall not be liable or give you a price reduction or compensation if our contractual obligations to you are affected by unavoidable and extraordinary circumstances beyond our control or the supplier(s) of the service(s) in question could not avoid it even if all reasonable measures had been taken. These events can include, but are not limited to war, threat of war, civil strife, terrorist activity and its consequences or the threat of such activity, riot, the act of any government or other national or local authority including port or river authorities, industrial dispute, lock closure, natural or nuclear disaster, fire, chemical or biological disaster and adverse weather, sea, ice and river conditions and all similar events outside our or the supplier(s) concerned control.

11. COVID-19 Related Disruptions

We understand the potential of COVID-19 to disrupt travel arrangements. In the event that this experience cannot happen as a result of COVID-19-related disruptions which render the entirety of the experience impossible (events include, but are not limited to border restrictions and airport closures) you will be offered the opportunity to postpone your experience to a different date agreed between us and you. Should you decide not to postpone the experience your cancellation charges will be in line with those listed in clause (3) three of this agreement. Please note that the option to postpone will only be offered for the entire group and not to an individual(s). In the event that you decide to postpone you may be subject to additional charges if price variations occur as a direct consequence of changes in:

  1. the price of the carriage of passengers resulting from the cost of fuel or other power sources;
  2. the level of taxes or fees on your confirmed arrangements imposed by third parties not directly involved in the performance of the booking, including tourist taxes; or
  3. the exchange rates relevant to the package.

12. Delay

Enroute54 is not liable for any delay which is due to ‘force majeure’ as defined above in clause 8. A delay to or cancellation of your transport/flight service does not automatically entitle you to cancel any other arrangements even where those arrangements have been made in conjunction with your transport/flight. However, you may be entitled to claim under the delay section of your personal travel insurance policy. Please contact your travel insurance provider in the event of such delays.

13. Conduct & Behaviour

If in our opinion or in the opinion of any other person in authority, your behavior or that of any member of your party is causing or is likely to cause distress, danger or annoyance to any of our other guests or any third party or damage to property, or to cause a delay or diversion to transportation, we reserve the right to terminate your arrangements with us immediately. In the event of such termination our liability to you and/or your party will cease and you and/or your party will be required to leave your accommodation or other service immediately. We will have no further obligations to you and/or your party. No refunds for lost services will be made and we will not pay any expenses or costs incurred as a result of termination. You and/or your party may also be required to pay for loss and/or damage caused by your actions and we will hold you and each member of your party jointly and individually liable for any damage or losses caused by you or any member of your party. We cannot be held responsible for the actions or behavior of other guests or individuals who have no connection with your booking arrangements or with us.

14. Disabilities, Medical Conditions & Special Requests

14. a) Disabilities & Special Requirements

We will give you information about whether the arrangements you have chosen are generally suitable for persons with reduced mobility but if you or any member of your party has any precise medical problem or disability which may affect your chosen arrangements, please provide us with full details before we issue our confirmation. We will only provide precise information on the suitability of the trip or holiday taking into account your needs if you specifically request us to do so. If you have any special requests, please notify us at the time of booking. We will do our utmost to cater for any special requirements you may have, however we regret we cannot guarantee the suitability of your chosen arrangements or that any request will be met unless we have specifically confirmed this. For your own protection, you should obtain confirmation in writing from us that your request/requirements can be met.

14. b) Medical Requirements

Should you have any special unanticipated medical requirements that arise during your trip you shall be responsible for the cost of any special medical and related arrangements that have to be made on your behalf. If we reasonably feel unable to properly accommodate the particular requirements of the person(s) concerned, we will not confirm your booking. If full details are not given at the time of booking, cancellation may be necessary (in which case we will impose applicable cancellation charges) when we become aware of these details. We and the supplier concerned reserve the right to refuse boarding in the event that we reasonably feel that an individual is not fit to travel. We will deem that person unfit to travel if in the 48 hours or less before departure they have suffered with any medical symptoms suggestive of a viral illness including but not limited to diarrhea, vomiting, high temperature or other flu-like symptoms.

15. Travel Insurance

It is a mandatory condition of booking with Enroute54 that you take out an appropriate travel insurance policy for the entire duration of your trip, which includes cover for cancellation charges and the cost of assistance, medical cover, personal accidents and repatriation, in an emergency. Travel Insurance does not form part of your contract with us or of any “package”. If you choose to travel without adequate insurance cover, we will not be liable for any losses, in respect of which insurance cover would otherwise have been available. You are required to carry proof of travel insurance with you and to produce this if reasonably requested by us.

16. Complaints

If you experience a problem during your trip, you must report it immediately to us, so that prompt efforts can be made to resolve the problem. At the time of booking, you will be provided with emergency contact details should you need to contact us urgently. In the unlikely event that a problem cannot be resolved at the time and you wish to complain further, you must send us full written details within 28 days of your return. Failure to take either or both of these steps will prejudice our ability to resolve your problem and/or investigate it fully. In consequence, any right to compensation you may have will be extinguished or, at the very least, substantially reduced.

17. Dispute Resolution and Governing Law

In the event of any dispute or claim arising out of or relating to this contract, or a breach thereof, the parties hereto shall consult and negotiate with each other and, recognizing their mutual interests, attempt to reach a satisfactory solution. If a mutually satisfactory resolution is not reached by the parties through negotiations within 30 days of such negotiations commencing, an aggrieved party may proceed to Court. This Agreement shall be interpreted, construed and enforced in accordance with the applicable laws of Ghana and all disputes arising in connection with this Agreement shall be finally determined by the High Court of Ghana.

18. Privacy

Information provided by you to us in connection with your holiday will be collected and held by us in accordance with our privacy policy. Please review our Privacy Policy which can be viewed here.

19. Third Party Rights

No one other than a party to this agreement, their successors and permitted assignees, shall have any right to enforce any of the terms of this agreement.
